Abstract
This Executive Order sets the rules for recovering costs from the person responsible for environmental damage or an imminent threat of environmental damage under the Danish Environmental Damage Act. It provides that the Danish Environmental Protection Agency may charge the responsible party for costs linked to administration and supervision, including relevant costs incurred by the Danish Agency for Green Land Conversion and Aquatic Environment. The Order specifies when payments are collected, generally each November for costs incurred during the preceding annual period, and allows earlier collection once a case has been finally concluded. Its annex sets a 2026 hourly rate of DKK 763 for relevant case-handling and supervisory work, plus full recovery of external service costs such as laboratory analyses or expert assistance, excluding VAT. It also defines which activities may or may not be included in the cost calculation, establishes time-registration and invoice-specification requirements, and provides for appeal to the Environmental and Food Appeals Board.
