Plant Health Regulation (No. 551 of 2025).

This Executive Order regulates plant health in Denmark, applying to the production and sale of plants covered by the EU Plant Health Regulation and to measures preventing the introduction and spread of specified plant pests. It requires relevant businesses, including those producing or selling certain plants, plant products and wood, to register with the Danish Agricultural and Fisheries Agency, and requires registered operators to obtain approval before issuing plant passports. It sets rules on approval of plants and plant products for sale, destruction of material that does not meet sale or quarantine conditions, prior notification of production areas for plants subject to testing for potato cyst nematodes, and mandatory reporting of suspected or confirmed occurrence of specified pests such as Fusarium circinatum and Epitrix species. The Order prohibits the introduction or spread of listed pests, requires compliance with EU emergency measures for certain plants, plant products and other objects, and obliges nurseries and horticultural producers authorised to issue plant passports to report and update risk-related production and marketing information through the official digital system. Its annexes set special pest-freedom, movement, heat-treatment and plant-passport requirements for certain plants, wood and wood packaging material, including conifers and species affected by pine wood nematode or Fusarium circinatum. The Order provides fines and administrative fine notices for breaches.
