Abstract
The present Act applies to the production and trade of plants and the control of undesired indigenous plant species. With the aim of protecting plant health, the law also applies to any species, strain, or biotype of pathogens, animals, and parasitic plants that are harmful to plants or plant products (pests). The law also applies to other objects through which pests can be introduced or spread, including soil and growing media. The Act devolves on the Ministry of Food, Agriculture and Fisheries the power to regulate different areas for the implementation of this Act, including on registration, etc. of professional operators; production and marketing of plants; measures against pests, etc.
The Act consists of 29 articles organized in the following chapters: 1. Scope of application and definitions; 2. Authorization to regulate production and marketing of plants and for measures against plant pests, etc.; 3. Purpose-specific payments, etc.; 4. Control and disclosure of inspection results, etc.; 5. Mandatory digital communication; 6. Delegation and appeals; 7. Penalties, etc.; 8. Entry into force and transitional provisions; 9. Amendments to other legislation; and 10. Territorial scope.
