Abstract
This Act provides for the legal framework governing the making available on the market and use of biocidal products and treated articles. It defines the scope of application of the Act, establishes exclusions, and designates the competent authority responsible for the implementation of its provisions and administrative procedures.
The Act regulates conditions for making biocidal products available on the market, including requirements for authorisation or registration. It sets rules on classification, packaging and labelling of biocidal products, and establishes restrictions on their availability, including limitations for certain categories of products. It also contains provisions on storage, handling, advertising and the submission of information relating to poisoning.
The Act establishes requirements for the use of biocidal products, including compliance with instructions for use and specified conditions. It defines professional users and professional providers of pest control services and provides for qualification, training and notification requirements. It includes provisions relating to pest control activities, including monitoring of harmful organisms, preparation of pest management plans and documentation of pest control operations.
The Act provides for state supervision and enforcement of compliance with its provisions. It designates competent authorities and specifies their supervisory functions and powers. It contains provisions on inspection and enforcement measures, state fees and charges, and administrative procedures. The Act also establishes liability provisions, including offences and penalties related to the making available and use of biocidal products.
