Regulation of the Minister of Climate Affairs no. 35 of 2023 concerning detailed requirements for the principles for calculating the share of renewable energy produced from biomass fuel and for demonstrating compliance with the requirements and criteria for biomass sustainability.

This Regulation, based on provisions of section 32, 3 (13) of the Energy Management Act, establishes specific requirements: on the principles for calculating the share of energy produced from biomass fuel and on the verification of compliance with the requirements and criteria for the sustainability of biomass; on the geographical origin and feedstock of biomass fuel. The Regulation applies to installations producing electricity, heat and cooling energy or fuel. Matters covered by the Regulation include: criteria for verification of compliance with the principles for calculating the share of renewable energy produced from biomass; categories of biomass, including: wood biomass from forest land, wood biomass from non-forest land, agricultural biomass, other wood waste, biomass produced during deforestation; auditing requirements; publication of information on fuels used.
