Regulation of the Minister of the Environment no. 39 2017 concerning the appointment of the observer, the requirements for the observer, the duties of the observer and the procedure and form of submitting the collected data for the observer on board.

This Regulation, made on the basis of subsections 1, 2, 4 and 5 of Section 68 of the Fishing Act, establishes the requirements and duties of an observer assigned to a fishing vessel, the procedure and form of submission of data collected by the observer, the scope of coverage with observers and the procedure for determining the period of the observer and his activity, in the fishing areas covered by the European Regulations (EU) of the European Parliament and the Council no. 2019/833, no. 2016/2336, no. 2017/1004, no. 2019/1241, and the Council Regulation (EC) no. 734/2008, and therefore concerns: fishing for deep-sea stocks in the north-east Atlantic; collection, management and use of data in the fisheries sector; conservation of fisheries resources and the protection of marine ecosystems; protection of vulnerable marine ecosystems in the high seas from the adverse impacts of bottom fishing gears; conservation and enforcement measures applicable in the Regulatory Area of the Northwest Atlantic Fisheries Organisation (NAFO).
Matters covered by the Regulation include: requirements and tasks of the observer; data collected by the observer; sampling plan used by the observer; procedure and form of submission of data collected by the observer; time period of observers' activities; appointment of observer to fishing vessels in and outside the NAFO Regulatory Area.
