Abstract
This Regulation lays down a derogation from Council Regulation (EC) No. 1967/2006 as regards the prohibition to fish above protected habitats and the minimum distance from the coast and depth for the ‘gangui’ trawlers fishing in certain territorial waters of France. In particular, articles 4(1) and 13(1) and (2) of Regulation (EC) No. 1967/2006 shall not apply in territorial waters of France adjacent to the coast of the Provence-Alpes- Côte d'Azur region to ‘gangui’ trawlers: (a) bearing the registration number mentioned in the French management plan; (b) having a track record in the fishery of more than five years and not involving any future increase in the fishing effort deployed; and (c) holding a fishing authorization and operating under the management plan adopted by France.
