Abstract
The present Framework Decision has been adopted by the Council of the European Union as a response to damages caused by intentional or seriously negligent ship-source pollution. The Decision aims in particular at strenghtening the criminal-law framework against ship-source pollution. For the purposes of this Decision, the definitions laid down under article 2 of Directive 2005/35/EC shall apply. An infringement within the meaning of articles 4 and 5 of that Directive shall be regarded as a criminal offence. Article 4 regards the penalties that shall be envisaged. Member States are required to ensure that legal persons can be held liable for the offences.
