Abstract
Directive 2005/29/EC of the European Parliament and of the Council of 11 May 2005 concerning unfair business-to-consumer commercial practices in the internal market establishes a unified regulatory framework to protect consumers from unfair, misleading, and aggressive commercial practices. Its structure comprises four chapters, encompassing 21 articles and 2 annexes.
In its introductory chapter, the Directive sets forth its overarching goals and delineates the scope of its application. Building upon this, Chapter II of the directive articulates a comprehensive prohibition on unfair commercial practices, encompassing misleading actions, omissions, and aggressive strategies. Chapter III delves into specific prohibitions, offering detailed guidance on practices like misleading advertising and unfair marketing. Ensuring effective implementation is the focus of Chapter IV, which delineates enforcement mechanisms and assigns responsibilities to national authorities. Chapter V encapsulates the directive's concluding provisions, addressing matters of implementation logistics, interplay with other EU directives, and mechanisms for ongoing evaluation.
