Abstract
The Directive (EU) 2024/825 aims to enhance consumer protection against unfair practices and provide better information for the green transition. It enables consumers to make informed decisions and prevents practices that mislead consumers regarding product sustainability and environmental claims.
The Directive consists of six articles. Article 1 introduces amendments to Directive 2005/29/EC concerning unfair commercial practices. It includes adjustments to certain definitions in Article 2 and provisions related to misleading actions in Article 6. Additionally, Annex I, which contains a list of misleading commercial practices, undergoes modification. Article 2 pertains to amendments to Directive 2011/83/EU on consumer rights, particularly revising definitions in Article 2. Furthermore, modifications extend to Article 5 regarding formation requirements for contracts other than distance or off-premises contracts. Amendments are also introduced to the information requirements for distance and off-premises contracts in Article 6, along with provisions of Article 8(2) on distance contracts. Chapter V (General Provisions) sees the insertion of two new articles, 22a and 27a. Article 3 imposes a reporting obligation for the Commission regarding the application of this Directive.
