Abstract
This Regulation lays down the rules for the application by the Union of the conservation, management, exploitation, monitoring, marketing and enforcement measures for fishery and aquaculture products established by the GFCM. This Regulation specifically provides for all commercial fishing and aquaculture activities, as well as to recreational fishing activities, conducted by Union fishing vessels and nationals of Member States in the GFCM Agreement area. This Regulation shall apply without prejudice to Council Regulation (EC) No 1967/2006. However, it shall not apply to fishing operations conducted by the Member States solely for the purpose of scientific investigations with the permission.
This Regulation sets out provisions on management, conservation and control measures for certain species under Title II, such as the establishment of fishing areas; spatial and temporal closures; specific measures to address IUU fishing activities; fishing gears and devices; control of landings; recording of catches; minimum conservation reference size; and identification and marking of fishing aggregated devices (FADs).
Title III determines technical and conservation measures, including but not limited to: reduction of the impact of fishing activities on sharks, skates and rays; incidental catches of seabirds, sea turtles, cetaceans and monk seals; fisheries restricted area; protection of sensitive habitats; financing concerning conservation measures resulting in temporary cessation of fishing activities; registration of authorised vessels; port state measures; port inspections; obligations of the Member States to prevent, deter and eliminate IUU fishing; and access to information and data related to monitoring, control and surveillance within the framework of joint inspection and surveillance schemes. Port state measures under Section II shall apply to third-country fishing vessels.
