Act relating to plant material (No. 1205 of 1994).

This Act applies to commercial production, importation and exportation and sale of plant material of horticultural species. It also applies to exportation to countries of the European Economic Area. Plant material of horticultural species includes plants and other breeding material of fruit-trees, berry plants, decorative plants, vegetable plants excluding vegetable seeds and bulbs intended for vegetable bulb production (sect. 2).
The 17 sections are divided into 5 Chapters: General provisions (1); Production and sale of plant material; (2); Supervision (3); Enforcement and penal provisions (4); Miscellaneous provisions (5).
The supplier of plant materials shall be an authorized supplier which shall be registered with the plant control authorities (sect. 3). The Ministry of Agriculture and Forestry may issue conditions and standards to safeguard the genetic quality and health. In section 4 reference is also made to the Plant Material Act 1203/94. Section 5 concerns requirements with regard to sale of plant materials and exportation to other countries of the EEA. Inspection of production, packing, transportation, etc. Of plant material shall be carried out by the Plant Production Control Centre.
