Abstract
The objective of the present Act is to to ensure high-quality plant production, food quality, healthy environment and the quality of freshwater resources by promoting the availability of safe, high-quality fertilising products suitable for plant production; promoting the appropriate use of fertilising products and natural fertilisers; and ensuring good consumer information on fertiliser use. It applies to the manufacture, placing on the market, use, storage, transport, export and import of fertilising products and component materials for fertilising products. The Act contains 49 Sections divided into the following chapters: 1. General provisions; 2. Provisions on fertilising products; 3. Business operation; 4. Conformity assessment bodies; 5. Competent authorities and their duties; 6. Supervision; 7. Administrative coercive measures and penalties; and 8. Special provisions.
All fertilising products shall meet the requirements of this Act or existing EU legislation on fertilising products; fertilising products may be made available on the market under the EU Mutual Recognition Regulation when they are legally marketed in another Member State of the EU. The Act authorizes fertilising products to be placed on the market in bulk or packaged, laying down the packaging requirements. As regards business operators, the Act lays down requirements concerning their reliability, reporting obligations, authorization, log-keeping requirements, etc. The Finnish Food Safety Authority shall be the responsible authority for for notifying, approving and appointing bodies for conformity assessment. It shall also prepare a yearly plan for supervision and a report on its implementation.
