Abstract
The present Act contains provisions supplementing Regulation (EU) 2016/2031 and provisions on certain other measures to manage plant protection risks and prevent the spread of plant pests. The purpose of the Act is to maintain good plant health conditions and thus promote agriculture, forestry, horticulture and food production business conditions and food safety and product quality.
The Act contains 40 Sections divided into the following Chapters: 1. General provisions; 2. Control of plant pests; 3. Marketing, use and import of macro-organisms; 4. Competent authorities; 5. Supervision and registers; 6. Coercive measures and penalties; 7. Damages; 8. Special provisions.
Section 3 stipulates that professional operators shall in all their activities observe the care required by the conditions so that plants, plant products, or other macro-organisms for biological control or pollination do not cause danger to plant protection. Registered operators shall appoint a person responsible for plant protection in their businesses.
The Act further lays down provisions on the rights and duties of the competent authorities, including the Ministry of Agriculture and Forestry, the National Food Administration, the Centre for Economic Development, Transport and the Environment, Customs, and the Finnish Forest Agency.
Section 15 stipulated that the National Food Administration shall prepare a national control plan for the purpose of directing and coordinating plant protection supervision.
Special provisions that are included concern the protection of people who report violations, designation of border inspection posts, delegation from the Ministry of Agriculture and Forestry, and fees for the performance of government agencies.
