Abstract
This Act concerns the control of international and domestic trade and related activities in endangered species of wild fauna and flora. The Act consists of 34 sections divided into 8 Parts: Preliminary (I); Field of application (II); Establishment of the Fiji Islands CITES Management Authority and the Fiji Islands CITES Scientific Council (III); Permits (IV); Transit and Transhipment (V); Registration of Traders, etc. (VI); Enforcement (VII); Miscellaneous (VIII).
This Act applies to any endangered or protected species listed the Appendices of CITES and in the Schedules to this Act (sect. 3). Section 4 provides for the establishment of the Fiji Islands CITES Management Authority which shall advise the Government on its obligations under the CITES and carry out other duties specified in section 6. The Fiji Islands CITES Scientific Council is established under section 7. The Council shall advise the Authority on export permits and carry out other functions specified in section 7. The Director of Environment shall be the Secretariat to the Authority and the Council. No person must export any specimen mentioned in section 3 except with an export permit issued by the Management Authority. No person must import any specimen mentioned in section 3 except with an import permit. A person who intends to import any specimen listed in Appendix I may apply to the Management Authority for a permit to import the specimen. Re-exportation requires a re-exportation permit (sects. 9 to 11). Section 12 provides for import or transport of an “introduction from the sea” of any specimen mentioned in section 3. The Management Authority must record the details of any permit issued by it in a register (sect. 15). Section 17 concerns species bred in captivity. No person must trade in specimens of any species mentioned in section 3 unless the person is registered with the Management Authority in accordance with section 21). Section 22 provides for the registration of captive breeders.
