Abstract
This Act is divided into two distinct Parts: Part II makes provision for the demarcation of the marine spaces appertaining to Fiji; Part III regulates the management and conservation of fisheries.
The 23 sections are divided into 4 Parts: Preliminary (I); Marine Spaces (II); Management and conservation of Fisheries (III); Miscellaneous (IV).
Sections of Part III carry the following titles: Application of the Fisheries Act (sect. 12); Calculation and apportionment of allowable catch by foreign fishing vessels (sect. 13); Licensing of foreign fishing vessels (sect. 14); Suspension and cancellation of licences (sect. 15); Licensing offences (sect. 16); Fisheries officers (sect. 17); Forfeiture of vessels (sect. 18); Security for release of foreign fishing vessels (sect. 19); Obstruction, etc. of fisheries officer (sect. 20); Non-liability of Fisheries Officers (sect. 21); Regulations (sect. 22); Fishing for research and sporting purposes excluded (sect. 23). The Archipelagic waters and waters comprised in the EEZ shall be part of Fiji fisheries waters as defined in subsection (1) of section 2 of the Fisheries Act and, subject to provisions of section 2, provisions of the Fisheries Act shall apply within those waters. Notwithstanding any provision of the Fisheries Act or this Act, provisions of the Fisheries Act concerning the issuance of fishing licences or to registration of vessels shall not apply to fishing by foreign vessels in the EEZ (sect. 12).
