Abstract
This Decree contains rules relative to registration, nationality and ownership of, and other rights and liabilities in relation with, merchant ships, including a vessel used or intended to be used for fishing or catching of other living resources of the sea. The Decree requires the Registrar to deregister a ship that is engaged in illegal, unreported or unregulated fishing activities. Such fishing activities are defined by this Decree. Ships shall be registered in accordance with this Act in the Fiji Register of Ships by the Registrar of Ships appointed under section 69. A ship that is not a Fiji-owned ship, may be registered if it is a ship that: (a) calls at ports or places in Fiji; or (b) is normally engaged on a qualifying route (as designated by the Minister; and (c) the operations of which are managed by the appointed ship’s agent on behalf of its owners, from a place of business in Fiji. The Act also concerns transfers, transmissions and mortgages of ships.
