Abstract
This Act makes provision for the protection of the environment in the State of Yap. It declares public policy in this field, provides for the creation of the Yap State Environmental Protection Agency, defines powers and duties of the Agency, requires environmental impact assessment studies to be prepared for specified activities and defines offences.
The Agency shall have the power and duty to control and prohibit pollution of air, land, and water in accordance with this Chapter and may adopt Regulations for purposes of this Chapter, including provisions on environmental impact assessment studies which shall be included in development proposals. The Agency shall further, among other things: establish criteria for classifying air, land, and water in accordance with their present and future uses and adopt and implement plans for the certification of importers and applicators of restricted use pesticides and for the issuance of experimental use permits for pesticides.
