Abstract
This Act provides for the reform of legislation regarding a Scottisch form of land tenure called crofting and for this purpose amends provisions of the Crofting (Scotland) Act 1993. It also amends the Crofters Holdings (Scotland) Act 1886, the Deer (Scotland) Act 1996, the Land Reform (Scotland) Act 2003, the Succession (Scotland) Act 1964 and the Scottish Land Court Act 1993.
Amendments concern the functioning of the Crofters Commission, obtaining approval from the Commission for matters regarding croft land, exchange of crofts or parts of crofts, subletting, division of crofts, the creation of new crofts and the extension of crofting tenure beyond the crofting counties. In addition, the Act lays down new statutory conditions as referred to in section 5 of the principal Act, inserts a new provision regarding complaints against breach of the statutory conditions by the Commission instead of a landlord and amends provisions concerning other legal proceedings.
