Abstract
These Regulations amend the Greenhouse Gas Emission Trading Scheme Regulations 2005 to enable operators subject to the EU Emissions Trading Scheme to use credits generated by the Kyoto Project mechanisms for compliance with the Scheme. They set out the process and requirements for obtaining UK approval and authorization for participation in the Kyoto project mechanisms (the Clean Development Mechanism and Joint Implementation). They also allow the Secretary of State to request information from operators not currently subject to the Scheme for the purpose of expanding or seeking to expand the scope of the Scheme and gives the Environment Agency and other regulators the power to collect all information required for the development of a National Allocation Plan. The Secretary of State may also request information from regulators and other persons for the purposes of compiling the national emissions inventory, being part of the UK s obligations under the Kyoto Protocol as elaborated in the Marrakech Accords.
