Abstract
These Regulations establish the procedure for applying for directions for additional compensation and submitting claims for additional compensation under sub-paragraphs 1(2) and (5) of Schedule 2A to the Land Compensation Act 1961 (c. 33) (“the Act”). Part 2 details the procedure for applying for directions for additional compensation. A direction for additional compensation must be issued by a confirming authority (the Secretary of State) in certain circumstances, as outlined in paragraph 1 of Schedule 2A to the Act. This applies when land has been compulsorily acquired, and the relevant compulsory purchase order (“CPO”) included a direction under section 14A of the Act (regarding cases where planning permission prospects are to be disregarded). Regulation 3 and the Schedule specify the information that must be included in applications for a direction for additional compensation. Regulation 4 outlines the notification process for the confirming authority when it deems an application for additional compensation invalid. Regulation 5 provides the steps for notifying relevant parties when a valid application for additional compensation is received. Part 3 concerns claims for additional compensation. When a direction for additional compensation is issued, any person previously eligible for compensation under the original compulsory acquisition may apply for additional compensation if the original compensation (“the original amount”) would have been higher. Regulation 9 outlines the procedure for making a claim for additional compensation. Regulation 10 establishes additional procedures when the land involved is subject to a mortgage and part of the mortgage debt remains unpaid. Regulation 11 specifies the steps the acquiring authority must follow after receiving a claim for additional compensation. Regulation 14 specifies the interest rate applicable to additional compensation claims and details how it should be calculated.
