Abstract
These Regulations give effect to Regulation (EU) 2016/2031 and Regulation (EU) 2017/625, and implement Council Directive 69/464/EEC on the control of Potato Wart Disease (OJ No. L 323, 24.12.1969, p. 1), Council Directive 93/85/EEC, Council Directive 98/57/EC, and Council Directive 2007/33/EC. Part 1 is introductory and includes definitions. Part 2 recognizes the Welsh Ministers as the competent authority for the purposes of the EU Plant Health Regulation and the Official Controls Regulation. Part 3 contain provisions on official controls on controlled consignments from third countries and other official controls on goods from third countries (plants, plant products and other objects). Part 4 regulates official activities to prevent the establishment or spread of plant pests. Part 5 and Schedule 1 impose additional temporary measures to prevent the entry of certain harmful plant pests into Wales. Part 6 regulates registration of professional operators and grant or issue of authorizations, licenses and certificates. Part 7 and Schedule 2 impose additional requirements in relation to certain solanaceous species (potatoes and tomatoes) to implement the Directives mentioned above. Part 8 notification requirements, Part 9 inspectors' powers, Part 11 penalties and offences.
