Abstract
These Regulations make provision concerning controlled reservoirs under Part 1 of the Reservoirs (Scotland) Act 2011. They, among other things: define artificial or partly artificial water areas; provide with respect to the calculation of the water volume that an area or structure or area is capable of releasing or holding; further define "controlled reservoirs" (as defined by the Act; provide for the registration of controlled reservoirs and the information that a reservoir manager must register with the Scottish Environment Protection Agency (SEPA); provide with respect review of risk designations under section 23 of the Act and appeals to the Scottish Ministers following a review by SEPA of risk designation; provide with respect to control on construction or alteration of controlled reservoirs and relative certification; and provide for resolution of disputes by a referee appointed under section 61(1)(a) of the Act by agreement between a reservoir manager and the relevant engineer.
