Abstract
This Order enforces in Northern Ireland Council Regulation (EC) No 1005/2008 and Commission Regulation (EC) No 1010/2009 establishing restrictions and obligations relating to illegal, unreported and unregulated fishing. It applies to Northern Ireland fishing boats, wherever they are, and to other fishing boats within the Northern Ireland zone. The Order, among other things: designates the Department of Agriculture, Environment and Rural Affairs as the competent authority for the purposes of the Council and the Commission Regulations; provides for controls on movement of consignments of fishery products; permits movement of such consignments under certain circumstances; provides for the refusal of importation or permission to use transshipment facilities in circumstances where a landing or transshipment declaration has not been submitted in accordance with Article 8 of the Council Regulation or Article 3 of the Commission Regulation; provides for a right of appeal to a court of summary jurisdiction in circumstances where importation or permission to use transshipment facilities is refused; and provides for powers of British sea-fishery officers.
