Abstract
This Act makes provision for a reform of water supply and sewerage in Scotland and provides for the control of water from coal mines.
The Act replaces the Water Industry Commissioner with the Water Industry Commission, which is established as a body corporate ,and strengthens customer representation in the water industry. Furthermore, the Act sets out certain restrictions on the supply of water to household customers, establishes a licensing regime for retail competition for non-household premises only, managed by the Water Industry Commission, defines certain functions of the water service company called Scottish Water (established by the Water Industry (Scotland) Act 2002), enables Ministers to issue Codes of Practice on sewerage nuisance and introduces monitoring and enforcement provisions to ensure compliance with such Codes and provides a statutory basis for powers of the Coal Authority for a programme aiming at reduction and prevention of pollution caused by the discharge of coal mine water.
