Abstract
This Act establishes Gambia Public Utilities Regulatory Authority as a body corporate. The functions of the Corporation shall include: monitor and enforce standards of performance by public utilities; promote fair competition among public utilities; examine rates and fees chargeable for the provision of regulated public services. The Act also concerns the administration of the licensing arrangement for the provision of the regulated public services listed in the Schedule to this Act. No person shall provide a regulated public service unless licensed to do so by the Secretary of State responsible for matters relating to a regulated public service or any other person specified in a legislation to issue a licence in respect of a regulated public service listed in Schedule to this Act. Services include electricity and water and sewerage. The Act provides for licensing arrangements, which will give the Authority the power to ensure that the interest of both the public utilities providing a regulated public service and the consumers of the service are adequately protected. A person aggrieved by a decision of the Authority may refer the matter to arbitration.
