Abstract
These Regulations, divided into 7 Parts and made under the Petroleum Products Act 2016, concern service stations licence and apply to all civilian installations. The Regulations give definition and interpretation of the relevant terms, including: adulteration; levy; oil marketing company; petroleum; petroleum products; service station; temporary bulk licence; vehicle. Concerning application for a service station licence, the Regulations provide for: notice of application, acceptance and evaluation from the Authority, proof of payment of levies, procedure for its issuing, suspension and revocation, particulars to be included in the license, transfer or assignment of license, definition and content of an environmental and sustainable management plan and of an environmental impact assessment; financial security provisions for land rehabilitation and prevention of pollution. Concerning enforcement, the Regulations provide for: powers of inspectors; taking and identification of samples; accredited laboratories for testing petroleum products. The Regulations also provide for record keeping of producers. Concerning construction permit and operation licence, the Regulations provide for application, construction specifications, inspection and certification of completion, environmental impact assessment, environmental audit for construction and operations. Final provisions concern fire safety requirements, including siting of petroleum service stations, warning signs, use and maintenance of fire extinguishers and absorbents, report of changes in representation, accidents or temporary interruptions.
