Abstract
This Act, consisting of 36 articles, divided into XII parts, provides for: supervision and monitoring of the importation, exportation, transportation, processing, supply, storage, distribution and marketing of petroleum products; licensing and control of activities and installations in petroleum products, in order to ensure appropriate health, safety and environment standards; encouragement and protection of fair competition in the petroleum products supply market. The Act applies to: the import, export, transport, processing, supply, distribution of petroleum products and related activities; the refining of petroleum into petroleum products and related activities; all persons, government institutions and agencies involved in petroleum products and related activities, with specific exemptions. The Act defines the relevant terms, including: biofuel; cartel; consumer; emergency petroleum products supply plan; environmental impact assessment; equipment; facility; petroleum and petroleum products; supply chain; used oils.
Matters covered by the Act include: Functions and powers of the Minister, including the power of making regulations; functions of the Authority in the supply chain; issuance of construction permits and operation licences and activities related to; obligation of permits and licences holders: compliance with the law, maintenance of records and provisions of information, minimum working stock requirement; supply chain inspection; establishment of the National Petroleum Information System; market competition and prohibition of activities against fair competition; regulation of pricing; protection of public health and the environment: implementation and adaptation of international standards and compliance with international conventions, performance of environmental impact assessment and preparation of an emergency petroleum products supply plan; national strategic reserves; offences and penalties; administrative matters and miscellaneous provisions.
