Abstract
An Act to consolidate and amend the law relating to (state) forests. The 45 sections of the Act are divided into 7 Parts: Without title (sects. 1 and 2); State Forests (sects. 3-5); Exploratory Permits (sect. 6); Contracts, Leases, Timber Sales and Permits for Forest Produce (sects. 7-13); Ownership of Forest Produce (sects. 14-16); The Protection of Forests (sects. 17-19); Offences and Legal Proceedings (sects. 20-36); Miscellaneous (sects. 37-45).
The Minister may, by Order, declare any area of State land (in the sense of the State Lands Act) to be a State forest, excluding all land owned by any person in such area. The President may grant leases in State Forests in accordance with section 5. The lease gives the lessee the right to use forest produce, but a royalty shall be paid on such produce removed from the leased land. Exploratory permits may be granted by the Commissioner of Forests under section 7. Sale of forest produce may take place by tender or auction if authorized by the Commissioner of forest officer. Section 14 concerns ownership of forest produce. Provisions on the protection of forest deal mainly with prevention and extinguishing of forest fires and damage to forest produce. The Minister may make regulations concerning the matters specified in section 45.
