Abstract
This Decision regulates exceptional price control measures for certain products in order to prevent the negative effects of price changes or to prevent monopolistic pricing of those products, following the decision of the Minister of Health to declare the COVID-19 disease epidemic caused by the SARS-CoV-2 virus of 11 March 2020, which ensures the protection of the health and life of people on the territory of the Republic of Croatia.
The products object of the terms of this text are listed as follows: flour; milk and powdered milk; eggs; sugar; salt; rice; pasta; fresh meat; fish; fruits and vegetables; meat cans; fish cans (fish products); edible oils and fats; baby food; baby diapers; drinking water; laundry detergents; dishwasher detergents; soap; water, space and hand disinfectants (including concentrated alcohol); protective overalls and other protective and medical clothing and footwear; goggles and visors; protective gloves; shoe covers; protective masks (for those coded as surgical, FFP2, FFP3); respirators/transport fans (human respiratory medical equipment); medicines and medical products; generic sanitary laundry items (health system medical laundry).
This Decision applies to entities engaged in the registered activity of production and trade on the territory of the Republic of Croatia. For the purposes of this Decision, in accordance with article 5 (subparagraphs 1 and 2) of the Law on exceptional price control measures, the highest price shall be considered the price of 30 January 2020, except in cases where the price increase of the product occurred solely for the reason of the increase of the original purchase price, regardless of the will of the economic operator. In case the retail price was determined in accordance with article 18 of the Law on consumer protection (Official Gazette 41/2014, 110/2015 and 14/2019) on 30 January 2020, the highest price is considered to be the retail price that preceded the price during special forms of sale.
The Minister of Economy, Entrepreneurship and Crafts is authorized in the event of a shortage of products referred to in this text, in accordance with article 36 of the Treaty on the Functioning of the European Union, to restrict their sale outside the territory of the Republic of Croatia. This kind of restriction shall not lead to a disguised restriction on trade between Member States of the European Union (see point IV of this publication).
