Abstract
This Regulation amends certain provisions of the Regulation on boats and yachts (Official Gazette 27/2005, 57/2006, 80/2007, 3/2008).
Article 4 of the Regulation on Boats and Yachts (Official Gazette 27/05, 57/06, 80/07 and 3/08) shall be amended to read: 1) Boats and yachts of Croatian nationality may navigate provided their seaworthiness has been established pursuant to the provisions of the Maritime Code and this Regulation, if they hold a valid navigation permit or a certificate of seaworthiness, if they are operated by a person holding the appropriate certificate of competency and if they are manned with the minimum number of crew necessary for safe navigation, established pursuant to the provisions of this Regulation. 2) Boats and yachts of Croatian nationality may be operated by a person holding a certificate of competency issued pursuant to the provisions of this Regulation. 3) By way of derogation from paragraph 2 of this Article, a recreational boat or yacht of Croatian nationality or a commercial boat or yacht that is chartered unmanned may also be operated by a person holding a document evidencing competency, issued by a competent body of another state provided that: a) the Ministry has concluded an international agreement on the mutual recognition of certificates issued by the competent or authorized bodies of the state concerned; or b) the Ministry adopted a decision on the recognition of certificates issued by the competent or authorized bodies of the state concerned on the basis of a comparison of foreign certification requirements with the requirements set out in this Regulation. 4) Information on recognized certificates shall be made publicly available on the Ministry's web site. 5) A legal or natural person chartering an unmanned boat or yacht shall be required to check whether the charterer holds the appropriate certificate of competency prior to chartering the boat or yacht. 6) The owner of a boat or yacht, members of his immediate family or a person holding a certified power of attorney shall be required to be on board the recreational boat or yacht referred to in paragraph 1 of this Article during navigation. 7) A foreign boat or yacht may navigate the internal waters and the territorial sea of the Republic of Croatia provided it meets the requirements set out in lex specialis, is seaworthy under the laws of the boat or yacht flag state, and is operated by or is under the command of a person qualified to operate it or be in command thereof. 8) Insofar as competency is not regulated by national legislation of the boat or yacht flag state, the person operating the boat or the yacht skipper shall have the level of competency as provided for in this Regulation. 9) Any boat or yacht navigating in the internal waters and the territorial sea of the Republic of Croatia shall have a nautical information chart aboard.«
Annex V is also changed.
The changes of the annex V are an integral part of this Regulation
