Abstract
This Regulation amends and adds certain provisions to the article 8 of the Regulation on the conditions and methods for the guard, and carrying out other jobs on ships, ensuring safe navigation and protection from the Pollution from Ships (Official Gazette 125/2005).
In Article 8, paragraph 6 of the Regulation on watchkeeping requirements and methods and attending to other duties on board ships which provide for safe navigation and protection of the sea against pollution (Official Gazette 125/05), after the words: “collective agreement” the words: “or agreement on the minimum working and social standards with annexes thereto” are added. (2) Paragraph 7 is amended to read: “(7) The company and the Seafarers’ Trade Union, pursuant to the regulations on the minimum number of crew members and the collective agreement with annexes thereto or the agreement on the minimum working and social standards with annexes thereto referred to in paragraph 6 of this Article, shall specify the minimum number of crew members in coastal line shipping in commercial exploitation (formation), and shall pass the Statement of formation composition of the ships’ crew in public coastal shipping for every ship sailing on a specific line, which shall be certified by the ministry competent for maritime affairs. (3) After paragraph 10, a new paragraph 11 is added which reads: “(11) All regulations and other relevant documentation (collective agreement, covenants, annexes etc.) regulating the working hours of crew members and schedule of the hours of work shall be on the ship and made accessible to all crewmembers.” Article 2 After Article 8, a new Article 8.a is added which reads: “Article 8.a (1) Night work shall not be permitted to crew members who are younger than 18 years of age. (2) Night work referred to in paragraph 1 of this Article shall be considered to be uninterrupted work lasting 9 hours which includes the period from midnight to 5 am. (3) The provision from paragraph 1 of this Article shall not include trainees in the deck department who are between 16 and 18 years of age when it reduces the efficiency of their training under the programmes and schedule determined in advance.
