Regulation on compensation for damages arising from the alienation of mineral resources.

This Regulation sets out the rules as regards the compensation for damage arising from the alienation or exploitation of mineral resources resulting from action of natural or legal person who performed mining operations without valid legal basis or valid authorization.
A natural or legal person who performed mining operations without a valid legal basis shall be obliged to compensate for the damage caused by such unlawful performance of works both Republic of Croatia, as well as to legal owner of that specific mine.
The type and quantities of unlawfully excavated or extracted mineral resources shall be determined by the Mining Inspector of the State Inspectorate on the basis of records on performed inspection.
The market value of mineral resources shall be determined on the basis of known mineral resources in specific deposit, which have been excavated or extracted on the territory of the Republic of Croatia during previous five years.
List containing the market value of mineral resources is in article 4. Compensation for damage arising from the alienation of mineral resources is here considered as direct revenue to the state budget of the Republic of Croatia (article 7).
