Abstract
This Regulation prescribes measures for remedying environmental damage and imminent threats of environmental damage, types, scope and methodology for preparing restoration programmes, issuing of approvals for restoration programmes and other related issues.
In terms of this Regulation a remedial measure is a specific activity and procedure which must be conducted in order to remedy a specific environmental damage and imminent threat of damage, which occurred due to a sudden event, or as a result of natural phenomena or as a consequence of performing dangerous or other activities.
Remedial measures may be: 1) emergency measures: used for removing imminent threats of damage and in case of a sudden event and for urgently removing occurred consequences and preventing the spread and multiplication of potential harmful consequences for human health and the environment, as well as for preventing further threats and domino effects after the occurrence of environmental damage; 2) other measures: used for removing the established imminent threat of damage or removing the consequences of occurred environmental damage caused by: a) performance of dangerous activities; b) performance of activities which caused damage to the environment and/or to the protected species or natural habitats, but marked as activities that have not been designated as dangerous within the meaning of the Regulation laying down the manner of establishing environmental damage; c) natural phenomena (flood, earthquake, ect).
Emergency measures, depending on imminent threat and occurred environmental damage and in relation to a specific environmental component and/or burden, in line with the competence prescribed by special regulations, shall be pronounced by the Minister or other head of the central State administration body.
The Annex is an integral part of this Regulation.
