Abstract
This Regulation stipulates: minimum reference sizes for the preservation of certain types of fish and other marine organisms and the method of their measurement; fishing grounds for certain types of fish and other marine organisms; the method of determining the amount of compensation for damages and the unit amount per kilogram of fish and other marine organisms based on which the amount of compensation for damages is also determined.
The provisions of this text shall not apply to fish and other marine organisms originating from cultivation. The minimum reference sizes for conservation will not apply to live organisms intended for cultivation. The minimum reference sizes for the preservation of certain species of fish and other marine organisms and the corresponding unit amounts for calculating the amount of compensation are shown in article 3 (tables 1 and 2). Measurement of the sizes of fish, shellfish and crustaceans is carried out in accordance with the instructions and graphic representations from Annex IV of the Regulation (EU) 2019/1241 of the European Parliament and of the Council of 20 June 2019 on the conservation of fisheries resources and the protection of marine ecosystems through technical measures, amending Council Regulations (EC) No 1967/2006, (EC) No 1224/2009 and Regulations (EU) No 1380/2013, (EU) 2016/1139, (EU) 2018/973, (EU) 2019/472 and (EU) 2019/1022 of the European Parliament and of the Council, and repealing Council Regulations (EC) No 894/97, (EC) No 850/98, (EC) No 2549/2000, (EC) No 254/2002, (EC) No 812/2004 and (EC) No 2187/2005. Fishing seasons bans (periods in the calendar year in which certain types of fish and other marine organisms may not be caught, collected, retained on a vessel, transshipped, unloaded, transferred, stored, sold, exhibited or offered for sale alive or in a fresh state, if they come from internal sea waters and territorial sea or are caught by vessels sailing under the Croatian flag) are determined in article 5. The fishing season for bluefin tuna (Thunnus thynnus) is determined by the regulation regulating the catch of this species. Article 7, 8 and 9 are regarding the offences and penalty provisions in relation to the effective or approximate damage that occurred. Inspectors and other persons authorized to carry out inspections, in accordance with the Law and the regulations adopted on its basis, determine in minutes the amount of compensation for damage caused to fish and other marine organisms in accordance with Article 8 and Article 9 of this Ordinance, based on the determination of the size and the mass of fish and/or other marine organisms, or the number of individuals in the case of sponges.

Provisions on the minimum reference size for conservation from article 3 of the table in paragraph 1 of this text for the species: dentex (Dentex dentex), scorpaena scrofa, gopher (Seriola dumerili), cantar (Spondyliosoma cantharus) and octopus ( Octopus vulgaris), as well as the provisions of paragraph 4 of the same article, shall enter into force on 1 July 2024.
