This Regulation determines rules regarding the public bidding procedure for determining the most favorable bidder in lease tenders, sales tenders and in the sale of agricultural land owned by the Republic of Croatia by direct negotiation. The public bidding procedure for determining the most favorable bidder is carried out: a) if several bidders in the tender for the lease, in the same order of priority, offered the same lease for the same cadastral plot and/or production and technological unit; b) if several bidders in the tender for the sale in the same order of priority offered the same purchase price; c) if several persons have submitted a request to purchase the same agricultural land by direct agreement. Public bidding in the case referred in items a) and b) shall be organized and conducted by the local self-government units, or the City of Zagreb, in whose territory the land is located; public tendering in the case referred to in item c) shall be organized and implemented by the Ministry of Agriculture. The starting rent/price at a public auction is the highest offered rent/price for the property that is the subject of a public auction (article 6).
