Abstract
This Governmental Regulation, implementing provisions of the Law no. 11 of 2020 concerning Job Creation, provides for spatial arrangement of the Indonesian territory, in order to implement the administration of spatial planning through definition of guidelines containing norms, standards, procedures and criteria; provide legal certainty and justice for all stakeholders in carrying out their duties, responsibilities, rights and obligations in the implementation of spatial planning. This Regulation concerns spatial planning, including space allocation for environmental protection and cultivation function; natural resources utilisation; urban area, whose main activities are non-agricultural functions; strategic area; public consultation; small and medium enterprises; land bank; forest area; marine spatial planning; zoning plan and the related activities; plan for zoning the coastal and island-coastal areas; coastal waters and maritime zones; protected area; ecosystem conservation and sustainable use of its resources; sea lanes and migration of marine species; local community; traditional fishery community, whose traditional rights are recognised in carrying out fishing and related activities; business permits.
Matters covered by this Regulation concern: preparation of general and detailed spatial planning; data analysis; issuance of related permits for business activity in the sea and for granting of rights over land management; definition of land rights; spatial plans regarding air space, land space and marine space; long and medium-term development plan; compliance with International Maritime Law; achievement of equitable development and economic growth and stability; community participation in spatial management; disaster management and related data administration; integration of environmental studies in the formulation of National Spatial Plans; allotment of space on the beach border, rivers, lakes, ponds, reservoirs and springs water; water resources utilisation; utilisation of green open space in urban areas; involvement of local communities in preparation of spatial plans; provisions regarding procedures for implementation of integrated management in environmental analysis; valuation of hazardous and dangerous materials, substances and explosives for areas designated for military bases; protection of biodiversity, ecosystem, terrestrial and marine flora and fauna and endangered species; realisation of marine infrastructure network systems; fish resources management and conservation.
This Regulation also provides for: valuation and definition of waters around natural world heritage sites in the sea and around environmental control areas. Space utilisation and utilisation activities concern: land tenure; building technical plan; utilisation of forest areas for development purposes; right of use of the resources of the territory; issuance of environmental impact certification and preventive assessment of the environmental impact of the activities.
