Regulation of the Minister of Environment and Forestry Number 8 of 2021 concerning Forest Administration, Preparation of Forest Management Plans, and Forest Utilisation in Protected Forests and Production Forests.

This Ministerial Regulation, implementing provisions of article 202 of the Government Regulations no. 23 of 2021 about Forestry Management, provides for: forest management, preparation of forest management plans, processing of forest products, forest utilisation, imposition of administrative sanctions concerning processing of forest products and forest utilisation. The Regulation concerns: biological natural resources; protected forest area; water management; flood prevention; controlling erosion; forest utilisation, including utilisation of timber and non-timber forest products; utilisation of environmental services; forest management unit; long and short term forest management plan; integrated business licensing system; standard certification; silviculture and forest cultivation system; marking of forest products to declare that products comply with sustainability standards; reforestation fund; forest waste.
The Regulation covers the following matters: forest inventory, for obtaining data and information regarding soil type, species, population, and habitat of flora and fauna; definition of various protected areas; content of forest management plan; duties and functions of forest management unit; roles and responsibilities of local governments; activities for enhancing forest rehabilitation, including: identification of critical land, improvement of cultivation, strengthening community participation, plant maintenance, forest protection and security, forest fire control; identification and mapping of forest areas for food availability and security; criteria and indications for utilisation of protected forests; provisions for utilisation of wood and timber resulting from logging; procedures for application, extension or restriction of business permits for forest utilisation; business activities allowed in protected forests: cultivation of medicinal plants, beekeeping, livestock, fruit and vegetables cultivation, agroforestry, wildlife sanctuary and animal rehabilitation, wild animal captive breeding, natural tourism, water resources utilisation, protection of biodiversity.
Further matters covered by this Regulation include: utilisation of timber for non-forest activities; processing of forest products; permit for processing forest products; assessment of sustainable forest management performance; legality of forest products; issuance of certificate; monitoring; forest product import declaration; administration of forest products; transportation and distribution of timber forest products; capacity building for private forest owners; penalties for forest exploitation.
