Abstract
These Regulations implement EC Council Directive 90/539/EEC on animal health conditions governing intra-Community trade in, and imports from third countries of, poultry and hatching eggs. The Minister for Agriculture and Food may, for the purposes of the Council Directive approve an establishment in respect of which he is satisfied that: (a) the conditions as regards facilities and operation set out in Chapter II of Annex II to the Council Directive are complied with; (b) a disease surveillance programme, taking into account the provisions of Chapter III of Annex II to the Council Directive, is being applied and adhered to; and (c) other conditions set out in regulation 5 are observed. A person shall not export poultry or hatching eggs unless they come from approved establishments (reg. 4). Minister shall suspend, withdraw or restore the approval of establishments in the circumstances described in regulations 6, 7 or 8. These Regulations also provide for approval of authorized officers to enforce the Regulations and the prosecution of offences. (15 regulations)
