Abstract
These Regulations concern foodstuffs intended for particular nutritional uses and give effect to Directive 2009/39/EC on foodstuffs intended for particular nutritional uses and to Commission Regulation (EC) No. 953/2009 on substances that may be added for specific nutritional purposes in foods for particular nutritional uses as amended by Commission Regulation (EU) No. 1161/2011. "Foodstuffs for particular nutritional uses” are those foodstuffs which: (a) are clearly distinguishable from foodstuffs for normal consumption, owing to their special composition or manufacturing process, and (b) are suitable for their claimed nutritional purposes and which are marketed in such a way as to indicate such suitability.
The Regulations, among other things, prohibit the manufacture or placing on the market foodstuffs intended for particular nutritional uses unless that food complies with the provisions laid down in these Regulations, the Directive and the EC Regulation. Those provisions concern, among other things, packing, labelling, presentation and advertising of food to which these Regulations apply.
