Abstract
An Act to implement various international agreements relative to compensation arrangements relating to oil damage, to make provisions for civil liability for oil pollution of the marine environment and payments into the International Oil Pollution Compensation Fund and other matters relating to the Fund. The Agreements are: the International Convention on Civil Liability for Oil Pollution Damage, 1969, done at Brussels on the 29th day of November, 1969; the Protocol to the International Convention on Civil liability for Oil Pollution Damage, 1969, done at London on the 19th day of November, 1976; the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1971, done at Brussels on the 18th day of December, 1971; and the Protocol to the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1971, done at London on the 19th day of November, 1976
The Act consists of 46 sections divided into 5 Parts: Preliminary and general (I); Civil liability for pollution damage (II); The International Oil Pollution Compensation Fund (III); Recognition and enforcement of determinations in Convention Countries (IV); Miscellaneous (V).
Provisions of Part II define the liability for pollution damage State and another country including exemption from liability and limitation on liability for pollution damage. For the purposes of calculating the liability of the owner of a ship by reference to the tonnage of that ship, the tonnage shall be ascertained in the manner as set out in section 11. Where the owner of a ship has, or is alleged to have, incurred liability for pollution damage pursuant to this Act, he may apply to the Court for an order limiting his liability for such damage to an amount calculated in accordance with the provisions of section 10. Section 13 concerns the power to stop or detain ship by inspectors. Other provisions of Part II concern insurance of ships and liability of guarantors.
