Organic Plant Produce Regulation about Production and Sale No.5768 of 2008.

This Regulation consisting of 46 articles prohibits (i) to treat any produce with ionizing radiation; (ii) the use, during the production of organic plant produce, of any element originating from genetically engineered plants or any element treated with ionizing radiation; (iii) to cultivate agriculture plant produce in a plot that is under organic conversion, unless signposts referred to organic conversion are fixed at the plot's entrances; (iv) to cultivate organic plant produce in an organic plot, unless signposts are fixed at the plot's entrances; (v) to process, sort or package organic produce, if someone else is processing, sorting or packaging non-organic products on the same place and at the same time; (vi) to store organic produce in a place that also stores non-organic produce; (vii) to present for sale organic produce in a place that also present non-organic produce unless it is separated and a signpost is fixed with the writing "organic produce"; (viii) to process, sort or package organic produce, unless he had thoroughly cleaned, disinfected and washed with water the equipment, tools and work surfaces that are placed at the processing, sorting or packaging areas; (ix) to use carbon dioxide in any of the cultivation stages of organic plant produce; (x) to use soil improvers and fertilizers other than the ones listed in article 22; (x) to use a compost not complying with all of the conditions listed in article 23.
The Certification and Control Body shall (i) authorize the marking of seeds and propagation agents with its control symbol when they are produced from plants originating in organic plant produce, for (a) at least one cultivation season, in annual crops; or (b) at least two cultivation seasons, in perennial crops; (ii) test the soil of the cultivation plot for residues during the conversion period. Infrastructure related to organic production regard (i) minimal distance from non-organic plots; (ii) prevention of erosion into and from the plot; and (iii) irrigation systems that have to be separated from irrigation systems used in non-organic plots and protected from contamination of the irrigation water by fertilizers, pesticides and feeding materials.
The Regulation allows only (i) to cultivate organic plant produce in the earth's soil (after receiving a written approval in advance it is possible to cultivate sprouts, mushrooms and plants in a raised bedding); (ii) the use of marked propagation materials and seeds (the use of unmarked seeds or propagation agents is permitted only if coplying with the conditions provided for in article 24C; (iii) prevention and treatment of plant pests in an organic plot carried out by using the methods listed in article 26, among others selection of genus and species, seed recycling, propagation of natural adversaries, steam or solar disinfection, harvest and mulching; (iv) mixed farms if all the provisions that are detailed in article 29 are fulfilled; (v) pest control measures in product processing areas carried out only by mechanical or physical methods
Packaging, storage and transportation rules, such as the use of recyclable packaging materials, and pest control measures inside organic produce storage areas, are given in Chapter I. Processing organic produce is possible only with (i) a valid producer license; (ii) the use of organic products (non-organic ingredients ca be use provided that their total proportion of the product's weight does not exceed 5 percents); (iii) the use of food additives that are not agricultural products only if they are necessary for the product processing and that they are listed in the annexed Schedule.
Article 38 deals with the import rules of organic plant produce and their accompanying documents, while article 39 regards their display or offer for sale. Inspections and sampling are regulated in article 45.
