Abstract
These Rules are framed in exercise of the powers conferred by the Environment (Protection) Act, 1986 (29 of 1986), and in supersession of the Batteries (Management and Handling) Rules, 2001. They apply to producers, dealers, consumers, and entities involved in collection, segregation, transportation, refurbishment and recycling of Waste Battery. Rule 4 lays down the obligations of Extended Producer Responsibility on the producers to ensure the attainment of the recycling or refurbishing obligations. Waste Battery collected by the producer shall be sent for recycling or refurbishing and not for landfilling or incineration. Rules 5 to 11 provide for responsibilities of stakeholders including consumers, waste management authorities, entities involved in collection, segregation and treatment, refurbishers, recyclers, and the Central and State Pollution Control Board. Rule 13 imposes environmental compensation for violation of Rules based on polluter pays principle.
