Abstract
This Act amends the Factories Act, 1948 (Act) in its application to the state of Maharashtra. In section 2 of the Act, the definition of factory in clause (m) is amended. Sub-section (2) of section 65 is substituted. Section 66 of the Act is amended to allow women workers to work even between the hours of 7.00 p.m. and 6.00 a.m. in any factory in which adequate safety and security measures or safeguards as may be prescribed are provided. Further, sections 79 and 85 are amended. A new section 92A is added, relating to compounding of certain offences mentioned in the Fourth Schedule. After the Third Schedule, a new Fourth Schedule is added which contains a list of compoundable offences, which includes, not maintaining cleanliness, not providing and maintaining arrangements for drinking water, washing facilities, canteens, lunch rooms, rest rooms and other required provisions as mentioned therein.
