Abstract
These Guidelines are framed by the Central Consumer Protection Authority in exercise of the powers conferred by Section 18 of the Consumer Protection Act, 2019 to provide for the prevention of false or misleading advertisements and making endorsements. They apply to all advertisements regardless of form, format or medium and all manufacturers, service providers or traders and also advertising agencies. The conditions for considering an advertisement as valid and not misleading are laid down. Also, conditions for bait advertising are provided. The Guidelines prohibit surrogate advertisement or indirect advertisement for goods or services whose advertising is otherwise prohibited or restricted by law. Further, the guidelines for free claims advertisements and children targeted advertisements are laid down. The conditions for disclaimers in advertisements is provided and the duties of manufacturers, service providers, advertisers and advertising agencies is laid down.
