Abstract
This Act provides for protection of consumers interest and mechanisms for redressal of their disputes. This Act consists of 107 sections across eight chapters: I. Preliminary; II. Consumer Protection Councils; III. Central Consumer Protection Authority; IV. Consumer Disputes Redressal Commission; V. Mediation; VI. Product Liability; VII. Offences and Penalties; and VIII. Miscellaneous.
Chapter I contains the short title, extent, commencement, application and definitions. Chapter II establishes the Central Consumer Protection Council as an advisory council, a State and District Consumer Protection Council in every state and district respectively. Chapter III establishes the Central Consumer Protection Authority to regulate matters relating to violation of rights of consumers, unfair trade practices and false or misleading advertisements which are prejudicial to the interests of public and consumers. It further provides for the composition of the Authority; qualification of its members; powers to investigate, search and seize, issue directions and penalties. Chapter IV provides for establishment of Consumer Disputes Redressal Commission at the national, state and district levels. It contains provisions in respect of qualification of the members of the various commissions, their salaries and conditions of service, jurisdiction, procedure for filing complaint, review and appeal.
Chapter V contains provisions relating to mediation of consumer disputes including creation of a consumer mediation cell in each commission, empaneling mediators, procedure and recording of settlement through mediation. Chapter VI provides for product liability action by a complainant against a product manufacturer or product service provider or product seller for harm caused by defective product and compensation for the same. Chapter VII contains offences and penalties. Chapter VIII empowers the central government to give directions to the Central Authority on questions of policy and frame rules for implementing the Act.
