Abstract
This Act is enacted to consolidate and amend the law relating to the prevention of corruption and for matters connected therewith.
The Act empowers the special Judges, and governs and defines corruption and its punishments. Chapter II provides for the appointment of special Judges. The Central Government or the State Government may, by notification in the Official Gazette, appoint as many special Judges as may be necessary for such area or areas or for such case or group of cases as may be specified in the notification to try the offences, including:(a) any offence punishable under this Act; and (b) any conspiracy to commit or any attempt to commit or any abetment of any of the offences specified in clause (a). Procedure and powers of special Judge is set forth in Section 5. A special Judge may pass upon any person convicted by him any sentence authorised by law for the punishment of the offence of which such person is convicted. A special Judge, while trying an offence punishable under this Act, shall exercise all the powers and functions exercisable by a District Judge under the Criminal Law Amendment Ordinance, 1944 (Ord. 38 of 1944). Chapter IV concerns the investigation into cases under the Act.
The Act further makes provisions, inter alia, for: offences and penalties; the investigation into cases under the Act; previous sanction necessary for prosecution; etc.
