Abstract
This Act provides for the management of water supply and sewerage in the urban local body areas in the state of Tripura. The Act consists of 123 sections over 8 Chapters: I. Preliminary ; II. Establishment of the Tripura Jal Board; III. Power and Functions of the Board; IV. Regulation, Control and Development of Ground Water; V. Transfer of Assets, Liabilities and Services Relating to Water Supply and Sewerage Systems to the Board; VI. Finance, Accounts and Audit; VII. Control; VIII. Miscellaneous.
Chapter I contains the short title, extent, commencement and definitions. Chapter II provides for the constitution and composition of the Tripura Jal Board (Board). It also lays down the criteria for appointment of the Chairman and other members of the Board, the officers and staff. Chapter III provides for the functions of the Board which includes treating, supplying and distributing water for household consumption; installing, operating and maintaining sewerage systems; regulating, controlling and developing ground water and sewerage systems; and promoting measures for conservation, recycling and reuse of water. The Board at its discretion and subject to availability may supply water for non-domestic purposes. The Board is empowered to cut off water supply or sewer connection, enter premises to prevent misuse or wastage of water, inspect and disinfect any well, tank, public hydrant and other powers as mentioned in the Act. Chapter IV allows the Board to notify any area to control and regulate the extraction or the use of ground water and a permit is required to be obtained to use ground water in such areas. Existing users in such notified area are required to be registered with the Board.
Chapter V provides that government may for public purpose transfer all rights, liabilities and obligations in local body in an urban area to vest in and stand transferred to the Board including its funds and employees. Chapter VI requires the Board to prepare a budget and publish in the official gazette, schemes in respect of which provision is made in the budget. The Board shall have a fund which can accept grants, subventions, loans, donations and gifts for central and state governments and other sources. Chapter VII provides that the Board shall comply with the directions of the government and shall produce such records or furnish reports as may be required. Chapter VIII requires the Board to submit a report to the government as prescribed by it. The Board has powers to make regulations and bye laws consistent with the Act. The Chapter also provides for offences and penalties for contravention of provisions of the Act and non-compliance of the orders passed thereunder.
