Abstract
This Resolution, consisting of 22 articles, aims at providing an adequate level of protection in the field of using living modified organisms resulting from modern biotechnology that may have adverse effects on the conservation and sustainable use of biological diversity. It is applied to genetically modified plants, animals and microorganisms. The Law takes into account risk to human health, with a special focusing on trans-boundary transport, implementing the Cartagena Protocol in terms of transport and deliberation, handling and use of living modified organisms.
Main objectives of the Resolution are: provide controls in introducing, trading, use and consuming of living modified organisms and preserve the diversity of the local genetic resources from the risks deriving from the introduction and release of living modified organisms into the environment. To achieve these objectives, shall be provided: a regulatory framework for research and development in the field of genetic engineering, employment of genetic engineering techniques and genetically modified organisms and their products to improve quality and quantity of agricultural production in a safe and controlled way. The Resolution applies to genetically living modified organisms for research purposes and agricultural use but not medical use: the details are set out in art.4.
A National Standing Committee on Biosafety is established to: develop plans and policies; provide and update bio-safety and import rules, conduct inspections on the establishments, develop risk analysis principles; issue approval to conduct genetic engineering research; prepare reports, studies and reviews. The Resolution states also that experiments, research, trade, circulation, spread, export, import, transit and transport of GMOs are possible only with the permission of the competent authorities and an ID card indicating the required information. It establishes as well duties and responsibilities of those working in the field. The provisions against those who violate this Resolution are included in art. 34 of Law No. 27 of 2009 on the Protection and Improvement of the Environment.
