Abstract
This Law consisting of 18 articles divided in VII Sections aims at: protecting the consumer rights by adopting the principle of justice and equality between processors and consumers of goods and recipients of services; maintaining consumer health and safety; reducing the industrial practices of fraud and manipulation of the process of packaging and related data and specifications; and raising the level of consumer awareness.
The Law establishes a Consumer Protection Council, chaired by a person experienced and efficient in matters related to consumer protection and composed of representatives of the concerned Ministries and agencies included a representative of one of the Agricultural Associations. The functions of the Council are mostly focused on policies and programs of action to ensure consumer protection mode. The Council also forms Inspection Committees aiming at controlling specifications of goods and carrying out inventory controls over their safety conditions in the stores and storage areas. The Law states consumer rights regarding: get all the information concerning the protection of legitimate interests; obtain full information on the specifications of goods and how to use and guarantees for goods; and claim before the courts for compensation for the damage that may be caused by a lack of access to information about the goods, not only about imported goods but also for manufactured goods nation-wide. Provision of correct information, data and specifications of goods and components of products is also a duty of suppliers and advertisers, to determine the quality of the goods.
The VII Sections are entitled as follows: Definitions and Objectives (I); the Consumer Protection Council (II); Consumer rights (III); Duties of duty of supplier and advertiser (IV); Prohibitions (V); Penalties (VI); and General Provisions (VII).
